In addition, if the mystery shopping is carried out by a local authority Trading Standards officer then it may amounted to the deployment of a Covert Human Intelligence Source (CHIS) under the Regulation of Investigatory Powers Act 2000 (RIPA).
This would require approval both internal approval and (from 1st November) approval from a magistrate. Please see my blog for more on this:
