We use styles of refusal letters which are very similar to those used for FOI purposes. We would explian that we do have information that has not been provided and explain why it has not been. The type of situtation where we would not do so would be in relation to prevention and detection of a crime. We would use the exemption set down in section 29 of the DPA where to advise of the existance of the information would prejudice an investigation.
Unfortunately, in Scortland we do not have the ability to refuse to confirm or deny the holding of personal data under FOISA.
