Hi all,
Does the Court of Appeal decision in Birkett v DEFRA mean that you can rely on a new exemption (except s.12) after receiving a decision notice that requires disclosure without actually having to appeal the DN to the Tribunal?
I suppose the question really is, would you need to appeal the DN and then apply the exemption or can you comply with the DN whilst also exempting the info?
