We would deal with the request from the solicitors as a subject access request in terms of section 7 of the DPA and charge. Section 35 of the DPA disapplies some of the provisions relating to the data protection principles in relation to the non-disclosure provisions. However none of these non-provision provisions apply to subject aceess requests and in my view therefore the rights under section 7 are separate from the more general rules about data sharing/use relaxed by s35.
