I wonder in what way the Housing Association can be said to be providing "confidential" services? (Disclaimer - I don't know a great deal about HAs)
Even if it can be said to be providing those services, I think the argument might falter somewhat on the "substantial public interest" and "necessary" grounds: to avoid gaining explicit consent, the processing must be in the s.p.i. AND be NECESSARY for the discharge of the functions.
That was why I asked Marilyn for more details. Having seen them I'm not convinced that the processing could be said to be in the s.p.i (whatever that means) and necessary for providing the functions they provide (although I can accept that others might disagree).
One way round it might be for the advisor taking the call to say at the start "we record calls for X purposes - do you consent to this?" and then stop recording if consent is not given?
Probably not an attractive suggestion though!

When looking for a Schedule 3 condition, don't forget SI 2000 No.417.
Paragraph 4 permits processing which:
"(a) is in the substantial public interest;

(i) is necessary in a case where consent cannot be given by the data subject,

(iii) must necessarily be carried out without the explicit consent of the data subject being sought so as not to prejudice the provision of that counselling, support, advice or any other service."
Comments;
Para 4(a) - I have no idea what this means.
Para 4(b) - this is extraordinarily broad because it extends to 'any other'
confidential service.
Para 4(c) - although it is not an open and shut case, I would have thought that either condition (ii) or (iii) could be met in the case under discussion.

We are a housing association, recording all calls to and from our call
