I'm picking up the definition of examination from section 5 of para 8 - "“examination” includes any process for determining the knowledge, intelligence, skill or ability of a candidate by reference to his performance in any test, work or other activity;"
Regarding harm, I'm coming at it from the viewpoint that if a further round of interviews were conducted for this role (particularly likely in this instance) and one candidate had had a copy of their answers to all of the original questions in addition to their scores, the other candidates would be at a substantial disadvantage. Not that these para.'s have any kind of prejudice test of course.
I appreciate that it's inevitable that a candidate that has already been through the process will have an advantage over others that haven't, regardless of whether they have a copy of their own answers or not. However, potential harm is not something I've taken into consideration here, it is purely a question of whether the info falls into para 8 or para 9. If it does fall into para 8 then it's releasable once the time bar has lapsed. If it's para 9 then the exemption applies without a time bar.
