I think I would have trouble being convinced that anything conducted as
part of an interview process was an "exam" in terms of the DPA

I agree with Lawrence. If the data is there's i.e. there answers and
notes on what they said and there is no 3rd party opinion involved why
not disclose?
Hasn't there been some guidance issued by the ICO this week regarding
access to exam information? I know this will apply to schools and
colleges etc but wouldn't the same principles apply?

Andrew,
My first thought is why not disclose? If it is their information, why
take this route? If you want to push them to court, I cannot see how
these would be sustained.
"I want a copy of my exam results and what was said about me at the
interview." Seems to me, at this stage, clear-cut case of natural
justice as implicit in the Act.
Are there specific overriding issues, not mentioned, that set the
approach to refusal?
I would need to know more before I could decide.
Best

Hi all,
Here's a question that I'd be interested to get some views on.
A DSAR has been made for all information relating to the subject during
an interview that they recently undertook. The information basically
consists of 3 categories of information. The answers to a test written
by the candidate. The responses to interview questions written by the
interviewers and the marks, grades and remarks made by the interview
panel regarding the written test and finally the written copy of the
responses to the interview questions.
The above information is considered for exemption as follows:
The written answers to the test - Exempt under sch 7 paragraph 9 as
information recorded by a candidate during an examination.
The marks, grades and remarks - potentially exempt under sch 7 paragraph
8, depending on the time limit, as marks or other infrmation processed
by the DC for the purposes of determining the results of an examination.
The responses to interview questions - ?? Written by the panel but
spoken by the subject. Para 8 or para 9?
I have already made my determination but I'm interested in what other
people think for the last category.
Thanks,
Andrew Goodfellow
