Brenda,
We provide records to the English equivalent body but redact anything that
is definitely not relevant to their investigation.
In addition, if we are providing them with anything which we think should
not be disclosed to the person being investigated (i.e. which would be
covered by a DP exemption to disclosure), we very clearly state that we
are providing the material on the understanding that they do not disclose
the relevant material to the individual.
We do both these things because it is their normal practice to disclose
all material provided to them to the individual.
Many Thanks

[data-protection] Care Council for Wales
Please can anyone tell me whether the 'powers conferred on the Care
Council for Wales under Section 59 of the Care Standards Act 2000' means
we have to provide them with documents relating to an ex-employee with no
third party redaction ? They are also quoting Schedule 2 para 5(b) and
Schedule 3 para 7(b) of the DP Act to permit the disclosure.
Many thanks
