HRA - I looked at that too. PCNs are civil not criminal. But some civil cases are covered as I understand it. Article 6 doesn't kick in unless it applies to the ‘determination of your civil rights and obligations’. And I don't think parking falls into that sort of area. Seesm to eb things like immigration matters or ETs?
Just to clarify, we are at no time saying we will refuse to give him info to fight his case that he is entitled to. I would never condone that. This is about the principle of SAR exemptions. He will get info he is entitled to under the correct process at the right time. There is a big difference between producing hundreds of bits of paper per case as and when it gets to the adjudicator (many won't even get that far) over a mantter of many months to producing several thousand pages within 40 days.
Philip, we got into a right tiz about which bits are DP and which aren't! A photo on its own of a car illegally parked may not be, but the minute you link it to a 'notice to owner letter'... ??
