On a first reading of the draft Code of Practice, there were a few small issues, but the main surprise was that the ICO seems to consider that a pure data processing agreement - where the processor has no uses of his own for the data (e.g. payment processing bureau) is a type of data sharing. I had certainly not considered processing agreements in this way. Does anyone have any views on this ?
