That is clearly a pure DP issue - as is anything relating to
pre-compulsory age children within a school, particularly once they
reach the 'age of understanding', relating to anything which is not part
of the educational record as defined.
So there IS no clear law in that everything is shades of grey in DP.
Often, particularly with the younger children, you can presume consent
from the relationship (not sensitive PD of course). Even if you cannot
there will usually be a Schedule 2 condition you can use to communicate
sensibly with the parent. For example if the parent is supporting the
child Condition 6 will usually be available.
In terms of practical steps I would recommend that any school / college
gives close attention to fair processing / privacy requirements for
post-GCSE students. Most schools for example would have a "what to
expect in the sixth form" guide for those staying on. In here should be
a simple statement along the lines "we will continue to discuss your
education and progress with ... unless ... ". They should also know how
to deal with the situation where a student expressly withdraws such
consent.
