I do not think we would do this for the police. This sounds more like
trawling to me. However, if the police asked 'How often does X come in and
use the PC in the library' we would consider providing the info if a Section
29 was issued and we were satisfied with the reason for the request.

Dear All,
I have been kicking around the following scenario when thinking about s.115
of
the Crime and Disorder Act and s.29 of the Data Protection Act and I wanted
your views on it from a Data Protection perspective.
I was thinking about these issues as they affect the Police asking for
information from the Local Authorities. What if they are asking for more
than
information and, in effect, asking the local authority to act as a data
processor on their behalf?
As crime and terrrorism are now likely to involve the use of the internet,
local
councils, and schools, who manage and maintain computers can be on the
frontline. As a result, staff could be asked to undertake activity that may
raise data protection issues.
For example, the police approached library or community centre staff and
asked that they keep a look out for suspects who are known to use
computers. The police provide photographs, names, and aliases. The staff
are
then asked to keep track of the suspects if they come to the site, make note
of their behaviour and what facilities they use, and then contact the
police. It
would appear that staff cold be in a position where they are carrying out,
unintentionally, surveillance. If they are asked to keep track of someone
who
is using their services? I can see possible RIPA issues emerging, but is it
for
the Police or the service provider to make the RIPA assessment?
At the same time, if the police are giving the staff photos, names, and
aliases
of the people of interest, does this become a data transfer for the purposes
of
the Data Protection Act? Furthermore, does the staff or the organisation
become a data processor on behalf of the police when carrying out this
activity?
What type of information sharing protocol could cover this situation?
I would be interested in your views on such a scenario. I realize that it
is
probably far fetched, but sometimes the extreme scenarios clarify the
thinking
about these issues.
