It seems quite explicit to me. Para 7A (1) says that you are in tier 2 if
you are "... not ... a charity ... and ... [have] a turnover of £25.9
million or more ...".
A charity cannot be in tier 2, whatever other characteristics it might have,
because the 'and' at the end of para 1b means that para 1a (not a charity)
and para 1c (turnover, etc) must *both* be true to put you in tier 2.
The thing that strikes me is the enormous jump from £35 to £500 in just one
step. That's not a tiered system, that's 'clobber the rich'.

This is wide open for debate I think and I can see the help-lines going into
meltdown with us all asking these questions. We are a Registered Social
Landlord, a registered charity with over 250 staff and a turnover in excess
of £25.9m and perform the role of a Public Authority. This could get

Also what happens to the Notifications for the Electoral Registration
Officer, the Youth Offending Team and the Registrar of births, deaths etc ?
Do they count as a local authority or pay the lower rate as having under 250
employees ? It doesn't mention those.
