I wouldn't have thought so - you have to take responsibility for your own actions for some things. I get those sort of emails all the time and just delete them and our emails are filtered. If the council supplied my details then it would be a different story.

Our organisation has an email filtering system which, for the most part is effective at removing spam emails from being delivered to individual officers, although occasionally the odd one get through.
An officer has received a phishing email asking for their bank account details, which they haven't responded to, but have forwarded to our helpdesk for logging.
This has prompted quite an interesting discussion - could the Council be held responsible for any losses which occur as a result of the individual proving their details in response to such an email?
