Totally agree Nic and I dare say you can ask the internal person who gave the reference if they had any objections to the release of the reference.

I seem to recal reading somewhere that the exemption applies whilst the reference is in the hands of the Data Controller who wrote it; as it hasn't left the Data Controller the exemption still applies. The right of access only applies when the reference is in the hands of another Data Controller.
Just because there is no right of access doesn't mean that access can't be provided.

We have a Subject Access Request which includes copies of 'internal references', ie employment references provided by a manager in this council in respect of a job vacancy in this council.
DPA Schedule 7 part 1 states that references given the data controller are exempt from the right of access. However in this case the data controller (the
council) both gave and received the reference.
I can't find any definitive opinion on this so would be grateful for any views
and opinions.
