I agree. There is only so far you can go to ensure "best practice" and
demonstrate "due diligence" before you start to become a nanny to your
employees. Surely a (I hate to say the word) "policy" that they sign up to
would be sufficient. It only needs to be a single page.
Your are responsible for appropriate insurance, licencing and MOTs, if not
you'll get a kick up the backside.....
Surely that meets H&S requirements?! Although more importantly you may wish
to check that it covers your insurance (in terms of liability) and check
with legal about their view.
Must say I am with Jeremy Clarkson on H&S matters.

Why not let the DVLA do the work of making sure people are MOT'd and
insured (which they seem to be quite ferocious about) and just ask for
proof that the car is taxed - which may not actually require a record of
the tax disc number itself.
Similarly, why can't it just be recorded that a valid driving licence
(in a person's name) has been seen, without gathering other details?
