..but because the court is required by statute to act in a way that is compatible with convention rights then in reaching any decision it must bear in mind the Article 8 right to a private life; and its decision must be consistent with that right, or its decision will be open to appeal. Which is what I was suggesting, in shorter form, in my original post.
