But IF there is room for argument in a case (and I accept your view that
maybe in this case there isn't) then I submit that it must be public
policy consideration that there are such test cases in order to promote
clarity in the law (e.g. the failed prosecution in R v Gold and
Schifreen [1988] AC 1063 (HL))
