Hi Brenda
We frequently get asked for files which are sensitive and extremely large (
2 filing cabinets is our current record). However, whilst legally we can
withhold for the reasons you suggest, we feel that a person in care should
know as much as possible about themselves as though they had not been in
care, in other words we have a parental responsibility to the individual,
and so we do release even though it will mean that we may be late on
disclosure.

Subject: [data-protection] Social Services files
We have received a SAR for a child care file. In these cases due to the
sensitive nature of the data they are dealt with by Social Services but
monitored by DP. Social Services have claimed -
copying all the files (of which there are a large number) would
involve "disproportionate effort" as referred to in the guidance for social
services p20 sec 5.29.
They have asked me to contact the data subject and ask exactly which part
they wish to have as they are unwilling to copy everything for the reason
above.
Has anyone else experience of this exemption under DP to not dislose/copy
all data.
Thanks
Brenda
