Sorry to join this string a bit late but the City closed yesterday as there

Tim's view that there is not a statutory right for an employer to provide
private facilities for email or telephone is , I believe, correct. However
if there are such facilities available then an employee can use them for
REASONABLE private use. (Nokia Corporation v Republic of France I think
around 2003) There is also other European case law which permits private use
of telephones but I cannot remember the dates.
On another However, care should also be taken with RIPA s1 which prohibits
the interception of communications which does included unopened emails if
addressed to an individual without consent e.g.
[log in to unmask] but this is probably another string to discuss
on another day.

The e-Mail and Internet system is primarily for business use. However, the
County Council recognises that in certain circumstances, particularly where
there is a need to communicate urgently, it may be appropriate for employees
to send personal messages externally or receive them from an outside source.
In addition, we recognise the need for individuals to have to carry out some
personal tasks while they are at the workplace, e.g. for Internet banking,
online shopping, non-business research, etc. Where these limited
circumstances apply, messages should only be composed or read or the
Internet accessed during their own time, typically lunch breaks. The use of
the employees County Council e-mail address e.g. [log in to unmask]
for carrying out personal transactions over the Internet is discouraged, as
it is likely that these e-Mails will be trapped by the e-Mail monitoring
system.
Personally, when I have to supply an email address for any site not work
related I use my personal BTInternet email address. I also use this to email
anyone outside of the Authority if it is personal - even if I am at work at
the time. I am also registered with this email address on some sites that
are work related and consequently periodically check for any mail I have
received. An example is some forums where they notify you if someone has
posted a reply to your question.
I use my work email address for any internal emails and for most work
related emails. I don't consider any email sent from or received at either
email address to be confidential or private.

Broadening the question to other local authority premises (eg schools) I
was surprised to learn that at my kids' school they are *only* allowed
to use hotmail etc. I suspect that's because they haven't issued the
children with email accounts on a local mail server [1], so webmail is
the only possibility. Why do they need to email anything you may ask:
well apparently it's commonplace to email half-finished projects home to
finish as homework (and a recent survey at the school found 98% of homes
had a PC).
Do any of this list's participants know of any "pupil email at school"
policies in place?
[1] Unlike staff, who have them.
