A road accident on the M25. The Highways Agency attend, document and move
all the vehicles on.
A question subsequently arises regarding the accuracy or legibility of a
registered number provided to one of the drivers by the Highways Agency. A
short phone call should be all that is required to confirm or correct those
details as a Highways Agency job number was obtained at the scene as a
result of a request for the details of the officer dealing.
subsequent contact with the Highways Agency to clarify the questionable
vehicle registered number resulted in the advice that because of the Data
Protection Act the Highways Agency do not respond with any information to
members of the public and that the insurance company would have to write to
the control centre involved to obtain the details. Pointing out that the
Data Protection Act did not forbid any such thing and that the Road Traffic
Act had some requirements regarding parties to an accident having
information did not change the advice, asking about SAR resulted in the
statement that no response would be made to a member of the public.
I seem to recall that the road traffic cameras were provided with some
exemptions from some parts of the DPA but not that the Highways Agency as a
whole were. Am I wrong is the DPA being used to hide or manage
administrative processes or merely the training not accurately recalled?
