I think that's a red herring. What you need to do, is think of the situation
where someone is standing by the side of the road with a hypothetical video
loud-hailer, and shouting adverts into your ears and eyes. It may be
antisocial, but it's not a breach of the Privacy Regulations (which are all
about marketing over public telecomms networks).
If someone can show that a peer to peer Bluetooth transmission of this kind
is an example of a public telecomms network, I'll gladly reconsider...
