http://www.the-dma.org/safeharbor/ and
http://www.export.gov/safeharbor/sh_overview.html specifically refers to US
companies and barriers to trade.

From what I gather it is a voluntary matter and few large corporations have
signed up to it.
This is also just based on some quick research.
I have found the advice on Edinburgh University's "Research and Data
Protection"
http://www.recordsmanagement.ed.ac.uk/InfoStaff/DPstaff/DP_Research/ResearchAnnexA.htm
which states:
"Personal data may also be transferred to the USA if the "Safe Harbor"
arrangements apply. (Please contact the records management section using the
email address below for further information about transferring personal data
to Canada and the USA.)"
This doesn't sound too promising!

Subject: [data-protection] Safe harbor / harbour
Does anyone know anything about the "safe harbor" framework which US
"firms" sign up to? Looking through the lists and "industry sectors" on the
website I can't see a single public organisation - does this mean that
public organisations e.g universities can't sign up to it, and hence none
of them are bound by data protection principles? I'm thinking about the
possibility of transferring personal data to recipients at other
universities. It seems odd that there is no obligation or option for public
organisations to sign up too.
