Subject: [data-protection] DPA Guidance re publication onto the internet
Hi all,
I am looking at developing some web specific guidance about the DPA.
We publish a great deal of information to the web which is subject to DPA
(ask others about recent removal of personal information).
Our current guidance is generic and I am seeking content/ideas about
developing advice specifically for web based content. I know generic
advice should be inclusive but I have been asked to look at publishing to
the internet as a specific.
Issues we have include the publication of names from meetings etc (this we
have already dealt with).
I want to make people more aware of issues relating to making various other
information available, photos, sensitive information (anonymised) which
when drawn together could ID the individual. Also advising on Subject
access rights re web based content (section 10 etc)
The title I have is "DPA and publishing to the Internet"
Has anyone done something similar or if not would like to contribute to a
short piece of work?
(An idea is not worthy being called an idea unless it is dangerous - Wilde)
Nick's reply:
I note having done a Google search that our colleague, Andrew Charlesworth,
has published a summary of all the laws that apply in this area

"Understanding and Complying with Data Protection and Libel Laws"
He has also published "Legal issues relating to the archiving of Internet
resources in the UK, EU, USA and Australia"

eg "Personal data placed on the Internet is available world-wide. In many
countries the use of personal data is not protected by legislation. Because
of this it is always advisable and often essential to obtain consent from
individuals before publishing personal data on a website."
