In the case mentioned its risk assessment, as a general rule you
automatically decide the extent of risk and the associated mitigation,
be that recorded or otherwise. I try to use the KISS principle and try
not to get too engaged in ifs. Analogy - Stay safe don't trust someone
who says I do not have an STD, wear a condom!

If you are in the process of drafting an agreement, I suggest you take a
look at (if not done so already) examples of where others have travelled
this road. A quick Google will quickly bring up many NHS protocols
(caveat
lector), and we found a great deal of work had been carried out in this
area
(Bristol, N Somerset has very detailed guidance)
In a recent project for the private medical sector (on similar issues)
we
found some very useful information from quite diverse sources.
The Crime Reduction website
(http://www.crimereduction.gov.uk/mini-sites.htm) has a series of mini
sites, one of which is dedicated to information sharing. Drilling down
you
will soon come across various proforma that could be useful.
And on the subject of 'explicit consent' I noted in the thread the view
that
this should be documented in some way. This is not always the case.
Explicit 'means what it means' (it's Latin again). The capture of a
signature is a means of verifying that consent was obtained, NOT that
the
consent was explicit. It all boils down to comprehension. If the
patient
fails to understand the implications of their consenting to data
sharing,
then the consent was not explicit (enough). The leaflet probably
doesn't
'cut it'.

My thanks to all of you who contributed to the discussion, which
confirmed
my opinion of how this particular situation should have been handled by
staff.
We do provide leaflets and training for our staff in Data Protection
issues,
but as you can see it is not always getting through to where it needs to
be.
We are currently drafting an Information Sharing Agreement with the
Social
Services Department, so I hope any potential customers to the Trust will
not
be put off by the discussion we have had today!
