According to an early April report from Baker & McKenzie, members of the
China National Democratic Construction Association, one of China's eight
legally recognized political parties, have just presented a Draft Law for
Protection of Personal Information and Data at the annual session of the
Chinese People's Political Consultative Conference, an advisory body to the
government of China. The Draft is the culmination of a multi-year process
in which Chinese scholars and policy officials studied data protection laws
in other countries, and created and submitted draft bills for discussion and
review. Little is known about the current bill, but earlier drafts appeared
to incorporate an EU-style "omnibus" data protection model, with
restrictions on the collection of personal information and obligations to
protect data from unauthorized use or disclosure, enforced via a regime of
administrative, civil and criminal penalties.

Subject: Data Protection legislation in China
Hi,
My organisation is involved with some Chinese organisations and I have
been asked to look into the data protection legislation for China. Has
anybody got any knowledge of what their situation is or where I could find
out more?
I contacted the Information Commissioner, but they were of no use. Also
done an internet search but found very little, so I am guessing they have
no legislation in place.
