Between April 2002 & March 2004 the National Care Standards Commission
undertook regulation and inspection of private & voluntary healthcare
(PVH). This responsibility transferred to the Healthcare Commission in
April 2004 and you'll find a lot of useful information on their website at
http://www.healthcarecommission.org.uk/Homepage/fs/en
The legislation affecting regulation & inspection of PVH services is still
primarily Care Standards Act 2000 (as amneded) and the Private and
Voluntary Healthcare (England) Regulations 2001 (as amended).
The information that PVH patient records must contain AND the retention
time for inspection is defined by these regulations, see
http://www.opsi.gov.uk/si/si2001/20013968.htm#sch3pI in particular.
The data subject's desire to have their records destroyed cannot overrule
the PVH organisation's obligation to comply with the law in this respect.
