All planning matters are in the public domain - including objectors
letters. The public has the right to inspect them and objectors are
warned that they are available to the public before they object. If
someone wants info they can do their own research on the publicly
available computer in the planning dept and check the online
applications FOC or use any computer in a public library FOC. If they
want the research done by the planning dept it is chargeable at market
rates. Taking into account FOI legislation as well, it is exempt as it
is already reasonably accessible to the applicant by other means, even
though it may be accessible only on payment (Section 21 FOIA) but of
course it may be different under FOISA.

There have been many objections to a Local Plan. A member of the
public
has phoned up and wants copies of all the objections including names
and
addresses. The Objection Form states under our DP bit that it is for
planning purposes but also the Town & Coun try Planning Act hasd to be
taken into consideration. I think the member of the public wishes to
canvass the people who have objected. They can come in and view the
objections but he wants names and addresses and I am not quite sure
about this as we obtained the info for planning purposes and certainly
do not say that we will make lists available to membersof the public
although the T & C Planning Act may say that we have to.
Has anyone had anything similar?
Thanks,
Doreen
