There is ICO guidance on this matter.
The Gillick Competence Test was dropped as a valid method of testing a child as
it is relatively complex. ICO guidance states that a child over the age of 12
can be considered to be able to make their own decision, however, it is
important that each request is dealt with on its own merits as there are mature
over 12's and not so mature.
I have tried to pull up the guidance, but cannot at the moment - it is easily
found on their site though....
