This call almost certainly did not originate from 02 (0.9 probability), but
is a call to a random number to try to sell you mobile services.

I get then often on Vodafone form people alleging they are authorised by
Voda to do it.

Probably working with O2 to seek to identify and solve this would be the
best idea here.

If they just us a number it is not against DPA, though it will be against
TPS if you are registered

Subject: Re: [data-protection] 02

Draft of letter I am sending to O2. Comments welcome.
-------------------------------------------------------------------

Approx. 1635 today I received the following call on my mobile from a
displayed telephone number of 0800 013 6662

"Hello, This is XXXX I'm calling from O2. How are you today?"

I asked him who he would you like to speak to.

He replied that he would like to speak to the owner of the phone and asked
me if that was me.

I said yes, it was, but asked him again what the name of the person was he
would like to speak to. He said: "We don't have your name, due to Data
Protection. We get our data from the open market. Yes, it could be from
websites or the from open market."

At this point I asked to be connected to XXXX's manager.

He stated his name was XXXX XXXXXX , and said he was a Customer Service
Manager for. 02 sales and that he was located in the Belfast office.

I asked him for his telephone number. He refused to give it, saying 02
didn't have any inbound lines in his office. I asked for the address of the
company. He refused to give this too saying "02 is a very large
organisation. I could give you a random address"

I said all I wanted was an address where I could write to the company,.

I asked him what the call was about. He said that his team were calling
non-02 contract customers

At this point I became suspicious that this was a scam and interrupted home.
I asked him to prove that he was from 02 (who I have always considered a
respectable company and my company has other mobiles with).

He said that he would sent a text message to my mobile phone with a
verification code which I could go to a website. He said that the fact the
text message would state it came from 02 instead of showing an originating
telephone.

He said O2 are the only people that can send a message saying its from
02 and without sending a number. I said I happened to know that was false,
as I work in telecommunications and am aware that a text message can easily
be made to appear to come from any name or number, just like email.

After more pressing he volunteered a telephone number for the company of
0870 600 3009. This proved to be the 02 Customer Services number.

I rang 02. A lady by the name of XXXXXXXXX took my call.

I asked to speak to the person responsible for Data Protection in 02.
She put me on hold, obviously consulting with a supervisor. She informed me
that 02 didn't have a Data Protection Department, and that she should be the
first port of call.

She told me that if I wanted to put a complaint in writing I should fax the
company on 0113 388 1153.

I was by now becoming convinced that I had been the recipient of an
attempted deception.

I asked her if the 0800 number was a number that belonged to 02 and she said
that she couldn't trace it. Upon calling the 0800 number there is just a
recorded message which advises people who are bothered by the telemarketing
purposes of the call to sign up with the Telephone Preference Service. She
also told me that to her knowledge O2 does not have a Belfast office.

Therefore please answer the following questions within the next 7 days.

1: Is the number 0800 013 6662 a number belonging to your company. YES/NO

2:Is the number 0800 013 6662 a number belonging to another company
marketing O2 products and/or services for you such as an outsourced
telemarketing company, reseller or other authorised agent for O2). YES/NO

3. If the answer to Q1 above is yes, admit that your company make a
telemarketing telephone call to my private number of 07973 263842 on or
about 1635 on 27th February 2006 YES/NO

4. If the answer to Q1 and Q2 above, is both no, will you report the matter
to the police?

Yours faithfully

Nigel Roberts
