You may be confusing the 1999 Microsoft case with the one imposed in
January 2001 on Zeppelin the producer of the tv progamme Gran Hermano
(Spanish Big Brother).
Zeppelin’s security system was breached and the data of the participants
in the programme were made available over the Internet leading to an
investigation by the Agenda Española de Protección de Datos (AEPD)which
imposed a fine of EUR 1 081 822, the highest they have ever levied in a
single proceeding.
Breaches of the Spanish DPA were as follows:
(1) failure to comply with the programme participants' information rights
(2) failure to obtain express consent for the processing of sensitive data
(3) failure to meet requirements for processing by third parties leading
to it being considered that an unlawful discloure had taken place
(4) failure to meet Principle 7
