I think, though I remain nervous of the geolocation services, there is one
important thing here that the "Find me by batphone working party" did that
BT did not.
They ensured that at least on Data Protection professional was part of that
working party.
Whether the service is perfect or imperfect is a different discussion. I
introduced the topic to make sure we were aware as consumers that, at least
in the short term, there may be stalking risks. But the working party took
a professional and at least partially privacy centric view before the
guidelines were introduced.
A valid pair of questions is "Who polices the guidelines?" and "How does an
individual who feels stalked find out who polices them guidelines?"
BT, by the way, may have changed their service, but they are as excellent at
customer service as ever.

If it is any consolation to members of the list, I admit to being a member
of the working party that developed the safeguards for the Location Based
Services that are run by the phone companies (not the location services that
are run by the satellite navigation companies - they will have to be
responsible for developing theor own guidelines).
The safeguards took over a year to develop and were approved and
comprehensively discussed with both representatives from the childrens'
charities and Home Office officials - and of course we consulted the
Commissioner's Office. We have also recently audited the main LBS providers
to check whether they were properly implementing the safeguards.
There are measures in place - both overt and covert - to detect and deter
people who wish to misbehave, and we are able to provide evidence to the
authorities should the wish to prosecute a miscreant. For obvious reasons I
do not want to reveal anything about the methodology used to trace
miscreants.
It may reassure some to think that I do not lie in bed at night worrying
about the possibility of my phone being tracked by a stalker. I am much more
concerned about the way BT found itself in the position it did a few days
ago.
Having said that, I also appreciate the tremendous pressures on large
companies to both reduce the "cost to serve" customers, while at the same
time trying novel and more ways of responding to anticipated demands. BT is
a huge organisation and I do feel sorry for those at the centre who strive
hard to keep up with advising on the DP implications of so many
customer-facing projects - and the project teams of course all have their
own agendas and can sometimes take a "commercial view" of the advice that is
offered to them.
It may have been BT this time, but I am sure most of us have horror stories
we would rather have forgotten than uppermost in the minds of the DP
community!
But it also shows what a group of strong willed people can do in a short
time, to highlight an error and get the Data Controller to suspend the
processing!

Hi, I agree with the concerns, but bear in mind that with the right controls
there is an up side too - for example helping to locate people taken ill in
their vehicles or whose vehicles have broken down and 'phone for a recovery
service. Everyone concerned just needs to make sure they get the right
controls/permissions in place.

I've heard of this service, their defence is that the SMS that are sent to
tell the phone owner that they are being tracked are completely random and
therefore will be difficult to intercept... not that I know the slightest
thing about intercepting text messages but that's what they do, they are
called world tracker I think.
It is supposed to be aimed at tracking lone workers and the like to ensure
that they are ok

Subject: Geolocation using your Batphone
We were chatting in the office this afternoon about the BT SMS mess. A
colleague said "What about the fact that I can locate you wherever you are
using your mobile phone?"
I knew the technology existed, but not how HE could locate ME. So he told
me.
If I did as we all do, and leave my batphone on my desk he could lock it in
to a service he paid for on a website somewhere and I would never know.
I
mean never. Because he would have intercepted all text messages informing
me that the service was being switched on.
He may have done it. The thing is I can't tell. There is no way I can ever
know about it
So, if it amuses him, he can track me when I take a pee, when I go shopping,
when I go to the gym, and, if he is a suspicious man and has put his nearest
and dearest into it, can see if they and I meet (as long as I take my phone,
that is).
Stalking and stealth. My only consolation is that he has to pat a trivial
sum of money to use the service.
If you use this technology to locate your staff, do they know? I used to
work for a large company that issued mobiles to us. They could have been
issued "ready set up to snoop"
I used to work with a guy who hated his boss. Actually we all found him
intrusive. When my colleague was in my living room in Bracknell the phone
often used to ring "It's Peter (boss)..... Where are you?"
"On the M6 Peter, bad line though...."
Peter would have had a field day as a control freak with this service
