This is about the CSA - or rather its sucessor. Until the legislation is at
least published, it is difficult to arrive at any views on the validity of
any naming and shaming approach. Looking at the precise words used, there's
a hint at crime....
You can "name" for purposes such as preventing or detecting crime or
apprehending offenders - note the recent Police move to do this in respect
of wanted sex offenders and the "Crimewatch" scenarios.
Even this can be tricky where the naming will have a demonstrable negative
effect on others - eg family members - Manchester case, a while ago.
You can also name where the information is in the public domain - eg
following a public Court case, although there are sometimes issues here,
too.
In short, you can do whatever you like, provided you comply with DPA and HRA
and......!

Act.
"Naming & Shaming" would seem to conflict with the DPA - any ideas on
how it actually fits in?:
The Government intends Publishing the names of fathers who do not pay
support to their children, on the Internet, to "name and shame" them.
How does this fit into the Data Protection Act?

Similarly our local Metro Transport company publishes fare defaulters to
"name and shame" them.
Can we "name and shame" payment defaulters to our organisation?
Can anyone clarify the relevant legislation?
Thanks
David Blewitt.
