Scotland, a child is not deemed to have legal capacity until the age of
16, whereas in England, Wales and Northern Ireland, the guidance has been
that by the age of 12 a child can be expected to have sufficient maturity
to understand the nature of the request. A child may, of course, reach
sufficient maturity earlier and it will be a question of fact in each
case." this implies that they have considered other guidence in producing
theirs but does not provide a reference to it. Perhaps someone at the ICO
would know the original source of this.
