I am pretty sure, from conversations elsewhere, that this is a universal
condition.

It renders the transaction something which the cardholder can complain
(bitterly) about.
And doesn't it pretty much automatically contravene principle 2:
"Personal data shall be obtained only for one or more specified
and lawful purposes, and shall not be further processed in any
manner incompatible with that purpose or those purposes.".
