Clearly there will be a need to publish every reported allegation, otherwise
early poorly informed administrative opinions regarding publication will be
prejudging cases with the result some are compromised and others not, or,
later publishing will illustrate administrative opinions of guilt but a lack
of supporting evidence. I wonder how anonymous reports will be dealt with.
The ICO must also be going to publish details of those organisations
investigated and found to be not guilty of the alleged offences.
I would guess the ICO is unlikely to publish the information if it would
compromise an investigation. Perhaps their published policy when available
will clarify that and many other questions which arise. Maybe it will be
similar to their media policy on this point.
I would also conjecture that the police and other investigative agencies are
likely to follow the ICO's administrative lead in this area and likewise
begin publishing similar material. Almost like blogs I suppose, but carried
out as officially sanctioned administrative actions.
Do the ICO fund damages found against them or does the government pick up
that tab?
I would be interested in the justifications for compliance in relation to
Principle 3, but maybe FOI provides the administrative justification whilst
at the same time providing legal protection against subsequent legal action.
A very interesting situation when fitted into some privacy paradigms.
