There is no breach of the DPA in the BBC approaching trading
standards and asking whether TS can supply them with information
about a named sole trader.
The test is not whether the BBC has passed personal data to a third
party, or whether it has been passed without consent, but whether the
passing on of that data is unfair. I don't see why the BBC saying 'is
there anything you can tell me about "John Smith Fish and Chips"?'
should be unfair in DP terms. No newspaper would ever be published
again in this country if it was.
Moreover, if its the BBC that's doing the asking, there are also the
protection of the DPA s 32 provisions on processing for journalistic
purposes.
