Yes, I would agree section 36, DPA (English) would apply in this type of situation.

Subject: [data-protection] Tape Recording
Social Services client recorded meeting between herself and her Social
Worker without informing the Social Worker. I don;t know the gist of the
conversation. My view initially is, yes, you are meant to inform people you
are recording but this is a private individual and the defence may be that
she wanted a true record of her meeting as sometimes clients feel it is them
against the organisation and cannot remember what was discussed. I can't
see that anything can be done in this situation although the other way
round, the Council employee would have to inform.
Anyone any thoughts?
