I thought Skill had sorted this one out with DfES some time ago.

My understanding is that if students are not in receipt of an NHS bursary,
they can apply to their LEA for Student Support. They have been released by
their employer to attend the course and therefore most of their earned
income must be taken into account which normally means that these students
are only eligible for non means tested support. This includes DSA plus a
loan of around £3000, should they wish to take it out.
