Hi Paul,
As far as I am aware, the Student Finance Office will meet with the
student and arrange a payment plan with them in order to pay for the
costs of repair/loss/damage to any item loaned to them. We have had
many discussions with the university insurance office and legal officer
and as far as their concerned, there doesn't seem to be an issue, but it
may be worth investigating further - not that I don't trust insurance or
legal personnel!!!

This kind of sanction may well be unlawful and unenforceable under the
Unfair Terms in Consumer Contract Regulations 1999 although of course
some HEIs may think that it's OK to do it as they can get away with it
in practice and the OFT is pretty toothless as a regulator. It will be
interesting to see how the Independent Adjudicator will look at it.
