There is a quite separate right, performers' rights, which means that no-one
may reproduce any part of a performance without the performer's permission.
It's part of the Copyright Act. The only question is what constitutes a
performance. The Act has a series of specific definitions (such as "a
dramatic performance"), but has a catch-all final definition "or any similar
presentation". The size of the audience is irrelevant - it can be "one or
more individuals". It's under this bit of the law that concert organisers
can insist on no photos or audio or video recordings being made.

Subject: More on photos
The thread on photos and exhibitions prompts me to ask a related question.
If you are taking part in an activity that is as much for public
entertainment as your own enjoyment, e.g. Saturday morning football or
morris dancing, would you expect to be treated differently if photographed
compared with an innocent spectator?
Is the situation different if the performers are children?
In addition, you may want to take photographs that could include
participants from other clubs at your events, which could even (!) end up on
a website. Would they have to give permission for this?
