Tim,
as you can imagine the police get many SAR's the intention of which is
to use the data in civil litigation with third parties. I had such a
case last week concerning third party litigation. I took the view that
I could withhold the documents in question. But just to be on the safe
side I spoke to the Commissioners Office Police Team. Their advice was
that the documents themselves could be withheld but the data contained
within the documents was still available to the Data Subject providing
it was their data and Section 7(4) - 7(6) considerations were taken.
I therefore did a cut and paste exercise and provided the relevant data
and not the original documents in redacted form.
