Here’s my twopennorth:
· Immigration & Nationality Directorate (IND) is a department of
government.
· I presume the University is a public authority.
· I suspect disclosure for Immigration purposes is ultra vires.
· Schedule 2 para 5.c needs to be satisfied in addition to fair and
lawful condition.
· Disclosure isn’t fair or lawful without meeting Schedule I part II
conditions either subject information or lawful requirement.
· IND need to demonstrate what enactment empowers either them to
require the information or you to provide it as per para 2 (b) Schedule I
part II.
· Cannot think of an exemption under the act unless the person is
suspected of crime – then IND could use Section 29.
Without an exemption or statutory requirement I think IND is up a gum tree
on this one. Schedule 2 para 5.c does not stand alone.
