This may sound obvious but the first thing necessary is to carefully
determine who is directing the surveillance.
Difficulties become inherent in these areas where the actual direction is
coming from the police and other agents are following those directions.
Once the subtlety of the data controller has been worked out the appropriate
regulatory regime can often become more obvious.
