The way in which this should be done, to comply with legislative
requirements, is to gather the data separately.
For example, when someone is sent an application form for a job they are
sent a separate form on which to answer the questions about sexual
orientation, ethnicity etc plus an addressed envelope in which to return
the form separately from the main application form.
Similarly, when employees are asked to provide similar monitoring data when
they leave/are disciplined/anything else they should be given the form
separately for returning to a central point where, as far as possible (and
I know it's very difficult in some cases like disciplinary matters) their
anonymity can be preserved.
I was horrified to find, in one organisation, that the forms were being
completed on behalf of the employees concerned by HR staff who were
questioning them - definitely not the way to obtain accurate data.
