I have been reading the discussion about Durant with interest.
Arguably Durant provides a more restrictive definition of the personal data to which a data subject is entitled. However, in my view, the decision should not prevent us from doing what we can to help a data subject to have access to information they are seeking about themselves. Surely, as DP
practitioners, our reason for being is to work within the spirit of the legislation. Certainly we need to balance this with the organisation's interests, however shouldn't it be part of our role to argue why the organisation should take a more permissive view than Durant about what the person
should receive?
I admit to becoming a bit disheartened by the rather negative discussion about the OIC and his enforcement role. Ultimately in my view, we are the gateway for people to exercise their rights. The OIC is there where an individual is unhappy and feels that the organisation has acted to limit these
rights; in many cases we are the ones advising in these situations. The power of our role in promoting privacy rights where it really affects people should not be underestimated.
I'm sorry if this stirs the pot, but I felt I had to say it.
