Roland, Isn't your exception too limited? My understanding is that email
addresses of incorporated businesses, including those addresses with
personal data (I'm not looking to rekindle the "is an email address
personal data?" discussion!), are not subject to the prior consent
requirement. A statutory E-mps could be relevant in this context?
If anyone wants to tempt fate the DMA run an E-MPS list you can register
on, based in the US. I've no idea how effective it is - Charles? See

There is no need for an EPS, because sending unsolicited email is
entirely not allowed. So you don't have to keep a list of people to whom
you can't send it, because *everyone* [1] is by default on such a list.
Of course, you can ask people if they'd like to join an email list, and
you are welcome to email such persons as agree, as much as you want. But
those emails are not "unsolicited", are they?
An Email Preference List would be rather like a Burglary Preference
List. Householders could add their names to a list, which would be
consulted by burglars before they set out each evening. And the
likelihood of the burglars paying attention to such a list, is much the
same as spammers. Indeed, those on the list clearly have a good reason
for being on it, so let's "do" them first...
[1] Except perhaps a few role-based addresses like "sales@"
