You're right, it doesn't look as though the Commission has made a decision
regarding the 'adequacy' of Australian privacy protection, yet. See

I'd give the Information Commissioner a quick bell because he may consider
that the Act already satisfies him and doesn't need to be scrutinised by the
EU.
