Lilly - I was in the same position in my last job (ie UK citizen working
for a US company in the UK). We had a UK-based HR department, and my
employment contract was based on UK law. We were allowed to opt-out of data
processing by the US company - although that had the corollary that those
who opted out wouldn't have had any share options either!
It seems to me that the employer is bound by UK law. One can't operate in
another country and unilaterally declare exemption from local legislation!
