As I said, if the corporation is US Centric, and data is not to be
transferred globally the Safe Harbour (sic[k] or otherwise), is a valid
mechanism.  Where data is to be transferred globally there is so far no
alternative.

There is no perfect mechanism.  But the time taken to administer intra
company contracts vs the time taken to administer BCRs is enormous.  A
corporation actually needs to keep trading.  In so many ways that is more
important than the jurisdiction under which they fall.  After all, the
directors have a duty to render profits to shareholders.  If the best
(current) method for them to do this is to adopt a binding protocol then
they will do so with very little hesitation, save only to validate that this
is appropriate for their trading needs.

So we move into practicalities, really.

Tim,

Our experience with model contract versus safe harbor [sic] is that model
contract forces a US organisation to be bound by the 'rulings' of overseas
Information Commissioners and (for the clients we have dealt with) the law
of England and Wales.  This is not something the majority of US corps are
comfortable with. Hence BCRs!?

This thread moves faster than I can type!

Still concerned over this jurisdictional issue.  My view: no living
individual falls outside of UK data protection legislation so long as their
data is processed (in any way shape or form) by a UK data  controller.

Now if one is simply seeking to exchange data with only the USA then Safe
Harbor is the "easiest" though it is pretty arduous and invites the FTC in.

With regard to the "Standard Contractual Clauses", my feeling is that these
are badly misunderstood.  The term "Model Contract Clauses" was used, and so
many people choose to see this as the "finished product" whereas they are
actually "model clauses" for contracts which will include some, all, or none
of them.

In reality they are a starting point for any corporation that wants to
ensure that it is legal in its data transfers and dealings. -----Original

No offence, Tim. I was thinking of the U.S.Department of Commerce website
and all the correspondance about the Safe Harbor Agreement. When I last
looked they weren't happy about the standard contractual clauses and that
was before the Article 29 WP started thinking about BCRs.
